Orliea Terms of Use
1. Who we are
Orliea is provided by:
Orliea UG (haftungsbeschränkt), Münsing, Germany
Registered at Amtsgericht München, HRB 315939
Managing director: Hanna Metz
VAT ID: DE465406349
Email: [email protected]
In these terms, "we", "us" and "our" mean Orliea UG. "You" means you, the person using Orliea.
These terms are the agreement between you and us about using Orliea. Paying for a subscription happens through the Apple App Store or Google Play, and section 8 explains how that fits.
Our Privacy Policy explains what we do with your data. It forms part of these terms.
2. What Orliea is, and what it is not
Please read this section carefully. It is the most important part of these terms.
Orliea is a record. You log how you feel each day, and Orliea stores it, organises it, and shows it back to you. You can put together a summary of your record for an appointment.
That is what Orliea does. Here is what it does not do:
- Orliea is not a medical device. It is not registered, certified or approved as one.
- Orliea does not diagnose you. It will never tell you what condition you have or might have.
- Orliea does not give medical advice. It will not tell you what to do, what to take, or what to stop taking.
- Orliea does not treat anything.
- No doctor, nurse or other clinician reviews your data. Nobody at Orliea reads your entries. There is no clinical oversight of any kind.
- Orliea does not monitor your health. It records what you enter. It does not watch for problems and it will not warn you about anything.
Orliea will never contact you about your health, however concerning your entries might look. If something is wrong, Orliea will not know and will not tell you.
Always speak to a qualified healthcare professional about your health. Nothing in Orliea is a substitute for that, and nothing in Orliea should delay you from seeking care. If you are worried about a symptom, contact your doctor. If you need help urgently, contact your local emergency services.
3. Who can use Orliea
You must be 18 or over. We check your date of birth when you sign up.
Orliea is not for children and is not directed at them.
You may only create an account for yourself, using your own email address, and you may only log your own health information.
4. Your account
Signing in is passwordless. We email you a one-time code. There is no password to remember, and no password for anyone to steal.
This means your email account is the key to your Orliea account. Anyone who can read your email can sign in as you. Please keep your email account secure.
Tell us at [email protected] if you think someone else has accessed your account.
You are responsible for the activity on your account.
5. Your data is yours
What you enter belongs to you. We store it and show it back to you. We do not sell it, we do not advertise to you, and we do not share it beyond the companies named in our Privacy Policy.
You can:
- Get a copy of everything you have logged, at any time: Settings, Data & Privacy, Export my data. Or email us and we send it within a month.
- Delete your account and your data, at any time, from Settings.
Deletion is immediate and permanent. We cannot recover deleted data, so get a copy first if you want to keep it.
Full detail is in the Privacy Policy.
6. What you put in, and what comes out
You choose what to log. Orliea does not verify it. If you enter a medication name or a dose incorrectly, Orliea will store and display it exactly as you entered it.
Please check your record before you rely on it, and especially before you share it with a healthcare professional. The summary builder shows you everything it will include before you create it.
Anything Orliea shows you, including counts, charts, cycle day numbers and estimated dates, is arithmetic performed on the information you entered. It is not a finding, an assessment or an opinion, and it is only as accurate as what you logged.
Estimated dates, such as when your next period might start, are estimates based on your own past entries. They are not a forecast of what your body will do.
Lab values read from a document by AI are pre-filled for you to check. Nothing is saved until you have reviewed and confirmed each value. Reading errors are possible; the responsibility for confirming the values is yours, and the original document stays in your record so you can check against it.
7. Using Orliea properly
Please do not:
- Try to access anyone else's account or data
- Try to get around our security, or probe or test it without our written permission
- Use automated tools to scrape, copy or collect data from Orliea
- Reverse engineer, decompile or copy the app, except where the law says you may
- Use Orliea for anything unlawful
- Resell or commercially redistribute access to Orliea
If you break these rules, we may suspend or close your account. Where it is reasonable to do so, we will tell you first and give you a chance to put things right.
8. Subscriptions and payment
Orliea is a paid subscription with a 14-day free trial. There is no free tier.
You buy through the app store. Subscriptions are sold through the Apple App Store or Google Play, depending on your phone. When you subscribe, your purchase is made from the store operator (Apple Distribution International Ltd or Google Commerce Ltd in the EU) under the store's own terms, which you see at checkout. The store processes your payment, issues your receipt and handles refunds. We never see or store your card details. Your right to use Orliea, and everything else in these terms, is between you and us.
Before you buy the app shows you the price, how long any trial lasts, and when the first charge happens. The price is in your local currency as set by the store.
Renewal. Subscriptions renew automatically at the end of each period until you cancel. The store charges your payment method at renewal. Price changes are announced by the store in advance, and you can cancel before they take effect.
To cancel: open your subscription settings in the App Store (Settings, your name, Subscriptions) or Google Play (Play Store, your profile, Payments and subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you paid for. The same steps are on our support page, which you can reach without signing in.
Refunds and the right of withdrawal. Refunds are handled by the store under its terms. If you live in the EU, the store gives you a 14-day right of withdrawal on digital purchases; because the subscription starts immediately at your request, the store asks you to acknowledge at checkout that the right ends when delivery begins. Ask the store for a refund through your receipt or your account there.
Restore purchases. If you reinstall the app or change phones, use "Restore purchases" in the app to reconnect your subscription.
Lost access. If a payment fails, the store will retry and tell you. If the subscription lapses, your record is kept for you and is available again as soon as you resubscribe. You can export or delete it at any time.
If you stop using Orliea. If your account has not been opened for three years and has no running subscription, we delete it and everything in it, as described in the Privacy Policy (section 10). We email you three times before we do, starting 60 days ahead, and opening Orliea once is enough to keep it.
For anything about a payment, contact the store. For anything about the app itself, contact us.
9. Availability
We work to keep Orliea running, but we cannot promise it will always be available or uninterrupted.
Orliea may be unavailable for maintenance, updates, or reasons outside our control. Where we plan downtime and can tell you in advance, we will.
Orliea depends on your internet connection and your device, which are not things we control. Some updates to the app are delivered automatically when you open it; major updates come through the app store.
10. Changes to Orliea and to these terms
Orliea will change. We add features, improve things, and sometimes remove things that are not working. We may change or discontinue parts of the service.
If we make a change that materially affects you, we will tell you by email before it takes effect.
We may update these terms, for example when the service changes or the law changes. We will tell you by email at least 30 days before material changes take effect, and the version number and date at the top will always show the current version. Previous versions stay available at orliea.app/terms-archive.
If you do not accept an updated version, you can stop using Orliea and close your account. Get a copy of your data first.
11. Ending this agreement
You may close your account at any time, from Settings. Cancel your subscription in the store as well, or the store may continue to bill you.
We may suspend or close your account if you seriously or repeatedly break these terms, or if we are required to by law. We will give you notice and a chance to respond where it is reasonable to do so.
If we close Orliea. If we ever stop operating the service, we will give you at least 60 days' notice by email, keep your data available to export throughout that period, and then delete user data. Please get a copy of anything you want to keep.
When your account ends, your data is deleted as described in the Privacy Policy.
12. Our responsibility to you
We take our responsibilities seriously, and we want to be clear and honest about them rather than hide behind long lists of exclusions.
Where we are fully responsible, and always will be. Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Intentional wrongdoing or gross negligence on our part
- Fraud or fraudulent misrepresentation
- Anything else that the law does not allow us to limit or exclude
- Your rights as a consumer under the mandatory law of the country where you live
Where our responsibility is limited. For any other loss, and only where it results from ordinary negligence on our part, our total liability to you is limited to the amount you paid for your Orliea subscription in the twelve months before the event that caused the loss, or EUR 50, whichever is higher.
What we are not responsible for. We are not responsible for:
- Decisions you make about your health. Orliea is a record, not advice. See section 2.
- Anything a healthcare professional does or does not do, including anything based on a record you shared with them.
- Information you entered incorrectly, or values you confirmed without checking.
- Problems caused by your device, your internet connection, your email provider, or the app store.
- Losses that were not reasonably foreseeable when you started using Orliea.
Nothing here affects your statutory rights as a consumer.
13. Which law applies, and where disputes are heard
These terms are governed by German law.
This does not take away any protection you have. If you live somewhere else, you keep the benefit of any consumer protection rules of your own country that cannot be contracted out of, and you can bring a claim in the courts of the country where you live.
If you are not a consumer, the courts of Munich, Germany have exclusive jurisdiction.
We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we do not currently do so.
14. Other things
If one part does not work. If any part of these terms turns out to be invalid or unenforceable, the rest still applies.
If we do not enforce something straight away. That does not mean we have given up the right to enforce it later.
Transferring this agreement. You may not transfer your rights under these terms to anyone else. We may transfer ours, for example if the business is sold, but only where your rights under these terms are not reduced. We will tell you if that happens, and you can close your account and take a copy of your data if you prefer not to continue.
Language. These terms are written in English, and English is the language of the contract.
The app stores. Apple and Google are not parties to these terms and have no responsibility for Orliea beyond the sale of the subscription.
14a. If you downloaded Orliea from the Apple App Store
Apple's developer agreement requires these points in our terms. They apply only to the App Store version of the app.
- These terms are between you and Orliea UG only, not Apple. Apple is not responsible for the app or its content.
- Your licence to use the app on Apple devices you own or control is limited to what Apple's App Store terms allow, including use through Family Sharing where offered.
- Orliea UG, not Apple, is responsible for maintaining and supporting the app. Apple has no obligation to provide support for it.
- If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price to you. To the extent the law allows, Apple has no other warranty obligation for the app; any other claim arising from a failure to conform is Orliea's responsibility, as set out in section 12.
- Orliea UG, not Apple, is responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and consumer protection or similar claims.
- If a third party claims the app infringes its intellectual property rights, Orliea UG, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when using the app.
- Our name is in section 1 and our postal address is in our legal notice; our email address is the contact for any questions, complaints or claims about the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
